Edisto Beach Real Estate-Obama'a Paying you to Short Sale your Home

...I was reading a blog from another agent and she was slightly confused or uniformed about short sales.  Help is on the way with the new HAFA program.  The Gov't is encouraging homeowners who do not quailify for refinancing or loan modifications to short sale their home.  As a matter of fact, they will even pay you some moving expense cash and pay the bank servicer to help cover the admistrative cost.  Howver, this must be your primary residence, the mortgage not over $729,750, you must be behind on your payments(can't just dump the house because your house is underwater), and you can't have a sleuth assets that can be used for collateral. 

   So if you have a House at the beach it must be your primary resicence and can't have a mortgage over $730,000.

 

Here is an excerpt from the National Association of Realtors.

 

 

On November 30, 2009, the Treasury Department released guidelines and forms for its new Home Affordable Foreclosure Alternatives Program (HAFA). HAFA is part of the Home Affordable Modification Program (HAMP). HAFA provides incentives in connection with a short sale or a deed-in-lieu of foreclosure (DIL) used to avoid foreclosure on a loan eligible for modification under the HAMP program. Servicers participating in HAMP are also required to comply with HAFA. A list of servicers participating in HAMP is available at MakingHomeAffordable.gov.

HAFA applies to loans not owned or guaranteed by Fannie Mae or Freddie Mac, which will issue their own versions of HAFA in coming weeks.

HAFA is a complex program, with 43 pages of guidelines and forms, designed to simplify and streamline use of short sales and deeds-in-lieu of foreclosure. HAFA:

  • Complements HAMP by providing a viable alternative for borrowers (the current homeowners) who are HAMP eligible but nevertheless unable to keep their home.
  • Uses borrower financial and hardship information already collected in connection with consideration of a loan modification.
  • Allows borrowers to receive pre-approved short sales terms before listing the property (including the minimum acceptable net proceeds).
  • Prohibits the servicers from requiring a reduction in the real estate commission agreed upon in the listing agreement (up to 6 percent).
  • Requires borrowers to be fully released from future liability for the first mortgage debt (no cash contribution, promissory note, or deficiency judgment is allowed).
  • Uses standard processes, documents, and timeframes/deadlines.
  • Provides financial incentives: $1,500 for borrower relocation assistance; $1,000 for servicers to cover administrative and processing costs; and up to $1,000 for investors for allowing a total of up to $3,000 in short sale proceeds to be distributed to subordinate lien holders (on a one-for-three matching basis).
  • Requires all servicers participating in HAMP to implement HAFA in accordance with their own written policy, consistent with investor guidelines. The policy may include factors such as the severity of the potential loss, local markets, timing of pending foreclosure actions, and borrower motivation and cooperation.

The program does not take effect until April 5, 2010, but servicers may implement it before then if they meet certain requirements. The program sunsets on December 31, 2012.

Edisto Beach Real Estate-National Market update

INFO THAT HITS US WHERE WE LIVE  New home sales fell 11.2% in January to a record low level. Existing home sales weren't very pretty either, down 7.2%, though they're UP 11.5% over a year ago. Let's remember that last Fall we all thought the tax credit was going away at the end of November. Many sales got pushed into October and November, causing sales drops the next two months. But the median new home price is down just 2.4% year over year and the average price is now UP 3.7%. For an existing home, the median price is unchanged from a year ago and the average price is UP 2.6%. More evidence home prices are stabilizing, with some analysts expecting modest gains for the year. Supporting this, the Case-Shiller home price index was UP 0.3% in December, its seventh straight monthly rise. 

Even more interesting was the news that this has actually been a very good decade for home prices. From January 2000 to December 2009, prices were UP 46%, making residential real estate a clearly profitable investment. And that's not even factoring in the mortgage interest and real estate tax deductions homeowners get!

Finally, we've reported that the Fed will stop buying mortgage bonds at the end of this month and experts feared rates may edge up. Now analysts say mortgage rates might not move much at all. This stems from the fairly calm market reaction to last week's hike of the Fed's discount lending rate (which is NOT the key Fed funds rate). Seeing little or no move in today's low mortgage rates is good news for the near term.

…So you don’t think you need a home inspection.  I hear this all the time.  Most guys will tell me that… “I am a handy man…I will save the money and inspect it myself.”  I always tell my clients to get a licensed home inspector.  These professionals have been trained to inspect and look for problems that a lay person may miss.  Pay the money-and get a little of piece of mind.  After all-your home is usually your largest investment.

Edisto Beach Real Estate-Have you seen Dear John?

Currently, South Carolina is enjoying an unusual level of international exposure, as the feature film “Dear John” has debuted in first place at Box dearjohnOffice.  Viewers readily recognize beloved locations like Edisto Island, Folly Beach, Sullivan’s Island and Charleston.   Not only is the film a beautiful picture postcard of coastal South Carolina – it also flexes its most important muscle for location filmmaking – its ability to double for exotic locations ranging from Afghanistan, Eastern Europe, and the Congo.

It is important to note that “Dear John” is the second movie based on a Nicholas Spark’s novel to be filmed in South Carolina. Like “The Notebook”, “Dear John” is set in North Carolina. In both cases the producers and director chose South Carolina over North Carolina.

The film also highlights some impressive native know-how: 52% of “Dear John’s,” production crew came from South Carolina.  A stellar performance considering that in 2005 the percentage of local hires was typically less than 20%.    That’s a huge boon to the attractiveness of South Carolina as a film destination, as it demonstrates the wealth of resident talent capable of capturing the highly paid jobs the film industry creates.  The supplier side also has generated impressive gains over recent years: “Dear John” found 58% of its suppliers, consisting of small in-state businesses, within the State.

At a time when the state is facing over 12 % unemployment, a $30 million film like “Dear John” can immediately bring hundreds of jobs and supplier opportunities to South Carolina communities while boosting the state’s #1 industry, tourism. As the State of South Carolina wrestles with budgetary shortfalls, cutbacks to state agencies threaten to profoundly impact the state’s future economic health.   Case in point, the Governor’s latest budget proposes to cut the South Carolina Film Commission, budget, reducing staff by 75%, (from 4 people to 1) and abandons its successful incentives programs. Ironically, this comes as the state was poised to capture a larger share of the film industry. Despite bipartisan and gubernatorial support for the incentives, newly appointed Secretary of Commerce Joe Taylor, reduced the incentive program while neighboring states passed incentive legislation that offered incentives at up to double SC levels.  As a result, SC has not had a major feature film since “Dear John,” which completed filming in December 2008.
